Abstract: The present work is devoted to the analysis of the draft federal law "On Amendments to the Criminal Code of the Russian Federation and the Code of Criminal Procedure of the Russian Federation in connection with the introduction of the notion of a misdemeanor." Some problems associated with the introduction of the category of misdemeanor in the legislation of the Russian Federation have been singled out. The author comes to the conclusion that it is not advisable to fix a misdemeanor in the system of categories of crimes. Several proposals have been made to improve the legislative initiative.
